When the police arrived at Dina's house, she was sitting on the steps holding her stomach with a cloth.72 Her insides were showing from the wound.73 Johnny and Andy had wanted to call an ambulance right off, but Cindy had stopped them. She didn't want Carlos to get in trouble. "So, I was just there bleeding," Dina recalled.74 "I lost a lot of blood . . . until I was [passed] out."75 Before losing consciousness and being taken to the emergency room, Dina provided a description of Carlos Hernandez that matched the person the police had arrested.76

At first, Carlos told the police he didn't remember anything. "He had a blackout."77 Later, he admitted to stabbing Dina but said it was an accident. In a written statement, he said he'd been in a fight with another man who had threatened him. He claimed that Dina tried to break it up and got in the way of his knife. Carlos didn't know the man, he said, and didn't see his face in the dark.78 The only other witness the police interviewed was Dina's son Andy. He backed up Dina's version of the story.79

Robert Mayorga was the Corpus Christi police officer who arrested Carlos Hernandez and took Dina's statement. Sergeant Mayorga had dated Wanda Lopez in the months before she was killed at the Shamrock and had arranged a set of hand signals with her so he'd know she was okay when he drove past in his cruiser without having time to stop.80
